Terms and Conditions of Service and Use

AkronCantonHomes.com is a classified advertising service, advertising homes for sale by owner as well as homes for sale with real estate agencies/brokerages. AkronCantonHomes.com is NOT an exclusively “For Sale By Owner” advertising service, and any real estate advertised with AkronCantonHomes.com is done at the discretion and with the full consent of the owner, agent, brokerage or any combination of the preceding parties.

AkronCantonHomes.com is not a licensed real estate broker, nor do we have any partnership with a licensed real estate brokerage. AkronCantonHomes.com is not a member of any Multiple Listing Service (MLS) and any property with an MLS number that is advertised on AkronCantonHomes.com is paid advertisement by the owner or agent with whom the home is for sale.

This web site and the services offered on it will be referred to collectively as the “Services” hereafter and are provided by AkronCantonHomes.com under the following terms and conditions of service and use. The terms and conditions of service and use will be collectively referred to as the “Terms” hereafter. Hereafter in the Terms, the words “we”, “us” and “our” refer to AkronCantonHomes.com. The term “website” will also be used to refer to AkronCantonHomes.com. Please read the terms carefully. You understand and acknowledge that the Services are provided to you exclusively under these Terms. By accessing and using the Services, you agree that you have read the Terms and fully understand them. You also agree to be bound by them, without any limitation or qualification.

SECTION I
AkronCantonHomes.com reserves the right to make changes to the Terms if we feel that it is appropriate. We will make you aware of any modifications by posting the changes on the AkronCantonHomes.com home page. If you object to any such changes, your primary and sole course of action will be to stop using the Services. Any continued use of the Services after notification to such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes, without limitation or qualification.

SECTION II a

AkronCantonHomes.com holds you (the user) responsible for safeguarding any vital or confidential information pertaining to your individual account with AkronCantonHomes.com. This information includes but is not limited to usernames, passwords or any other information which is used to log into or manage your account. AkronCantonHomes.com holds you (the user) responsible for all activity that takes place under your account.  Any breach in security or unauthorized activity occurring under your account should be immediately reported to us. We will not be held responsible for any losses or damages you may incur resulting in your failure to adequately safeguard your username and password.

SECTION II b
AkronCantonHomes.com holds you responsible for maintaining the accuracy of any information published under your account. The user is solely responsible for updating or expiring any information that is no longer true or accurate, including but not limited to the following instances: (a) The home has a sale pending (b) The home has been sold (c) The home is no longer for sale (d) The home is no longer for sale by the owner of the home (e) the home is under a contract with a Real Estate Brokerage (f) The home has an exclusive listing agreement with a Real Estate Brokerage . AkronCantonHomes.com reserves the right but is not obligated to monitor any or all of the information and activity that is published or takes place on the website. If we believe that any of the information published on the website is untrue or inaccurate in any way we reserve the right to remove this information or terminate the account under which the information was published with or without notification to the registered user of that account. WE CANNOT AND WILL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES INCURED (WHETHER ON THE PART OF THE SELLER, THE BUYER OR THE PROSPECTIVE BUYER), DUE TO INACCURACY OF ANY INFORMATION PUBLISHED BY YOU OR PUBLISHED UNDER YOUR ACCOUNT, OR FAILURE AN ANY OTHER WAY TO COMPLY WITH THIS SECTION

SECTION II c
By selecting the $30/ month advertising plan the user acknowledges and gives AkronCantonHomes.com permission to charge the credit card with which the ad was paid for a $30.00 fee every 30 days until the user expires the ad. It is the user’s responsibility to maintain his or her account and to make sure that each listing under that account remains current. Refunds WILL NOT be given in the event that the user fails to remove a home ad under his or her account.

SECTION II d
By selecting the $30/ per month advertising plan the user acknowledges and gives AkronCantonHomes.com permission to encrypt and store their credit card information for future billing, and assumes all risks of having credit card information stored in our database. The user agrees that AkronCantonHomes.com will not be liable for any losses or damages that occur due to having their credit card information stored in our database. If the user objects to having their credit card information stored they may bypass this procedure by selecting the $99.00 (advertise until sold) plan.

SECTION III
AkronCantonHomes.com holds you (the user) responsible for making sure all of the information you provide us with during the registration process is true and accurate. If we believe that any of the information given during the registration process is untrue or inaccurate in any way we reserve the right to remove this information or terminate the account under which the information was given with or without notification to the registered user of that account. You the user by registering and creating an account with AkronCantonHomes.com acknowledge and attest to the fact that you are 18 years of age and are the homeowner, spouse of the homeowner, power of attorney to the homeowner or licensed real estate agent/broker representing the homeowner in regards to the property which is being advertised.

SECTION IV
You (the user) agree not to use AkronCantonHomes.com to do any of the following:

    • violate any local, state, national or international law;
    • use contact information given to solicit products or services to the users of our website;
    • stalk, harass or harm another individual;
    • collect or store personal data about other users;
    • impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity;
    • interfere with or disrupt the Services or servers or networks connected to the AkronCantonHomes.com Web site or the other Services, or disobey any requirements, procedures, policies or regulations of networks connected to the AkronCantonHomes.com System; and
    • submit, post, store or transmit any (a) Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, racist, sexist, or ethnically or otherwise objectionable; (b) Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships; (c) Content that infringes the intellectual property rights of a third party; or (d) material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

SECTION V
AkronCantonHomes.com is an advertising service. We are not the publishers of any content or information that is supplied in the home advertisements or banner advertisements on our website. All of the content and information found in the home advertisements and banner advertisements is provided by the party/ parties who paid for the advertisement and is simply distributed by AkronCantonHomes.com
AkronCantonHomes.com holds no affiliation to, nor do we endorse any of the following:

  • Companies, Parties, Individuals or Entities choosing to advertise on the website.
  • Companies, Parties, Individuals or Entities displayed on the Links page of the website
  • Companies, Parties, Individuals or Entities offering services to the users of the website.

Any business dealings, correspondence or purchase of products and services with any of the Companies, Parties, Individuals or Entities found on or through AkronCantonHomes.com are between you (the user) and the Company, Party, Individual or Entity. AkronCantonHomes.com is not responsible for any losses or damages incurred due to your business dealings with any such party.

YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE AND NON-INFRINGEMENT WITH RESPECT TO THE SERVICES.
WE MAKE NO WARRANTY THAT (A) THE SERVICES WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; (B) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; (C) THE ACCURACY, RELIABILITY OR QUALITY OF ANY INFORMATION, PRODUCTS, SERVICES OR OTHER MATERIAL OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS; (D) DEFECTS IN THE SERVICES WILL BE CORRECTED; OR (E) THE AkronCantonHomes.com WEB SITE OR THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR INFORMATION DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM(S) OR FOR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR INFORMATION.
WE DO NOT CONTROL IN ANY RESPECT ANY INFORMATION, PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES, AND WE MAKE NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICES OR ANY TRANSACTIONS ENTERED INTO THROUGH OR AS THE RESULT OF THE SERVICES.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM AkronCantonHomes.com OR THROUGH OR FROM THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
